PRIVACY POLICY

This Privacy Policy describes how Higher Ground, LLC (“we” or “us”) collects personal information in connection with our SatPaq device and SpaceLinq service and mobile app (“the Service”) and through our website, and how we use and share that information. This Privacy Policy should be read in conjunction with our Terms and Conditions of Use, available here Terms & Conditions, which govern all use of the Service.

The SatPaq enables Go Anywhere Messaging for your smartphone. Whether you are out of bounds, off the grid, on the water, or off road, the SatPaq transmits your message 23,000 miles into space and on to its destination. The SatPaq also enables you to contact public safety in an emergency, search educational first aid information through the Dr. Dex service, obtain instant weather forecasts, and share your activities with friends and family through social media.

What Information We Collect and How We Use It

The information that we collect from and about you helps us to provide the Service to you and to improve our Service and our website.

Contact Information. When you establish an account with us, we require you to provide certain contact information to us. We also may collect information from you when you contact us through our website, mobile app, or other means. We use this information to provide the Service, to contact you, to send your SatPaq when purchasing and may provide it to a 3rd party partner, for example, when a user requests our SOS service.

Usage Information. We collect certain information about how you use the Service. This information can include, for example, the location of your device, the number of messages you send, your messaging records, and other information related to your transmissions. It also may include information related to your use of the SpaceLinq app, and information you provide us in connection with your use of the Service, such as questions you submit to Dr. Dex and communications you make through the Service. Except for information you send to us or one of our partners, we will not monitor the content of your messages. We use this information exclusively to provide the Service, including to bill you for your use of the Service, to monitor service quality, and to improve the Service.

Device Information. We may collect certain information about and from your mobile device when you use the Service. For example, we may collect information like the operating system of your device and its unique identifier. We use this information to provide and improve the Service.

Social Media Information. We offer the capability to broadcast information to your friends and family through social media, including Twitter. In order to provide this service, we need your login information, including user name and password, for the social media platform you choose to use. We also may need contact information, such as cell phone number, of the contacts to whom you want to broadcast messages. We use this information only to provide you with the capability to broadcast messages to your friends and family through social media, and for no other purpose. Please note that by using the social media plugin, the information you provide may collected by the social media provider. Please check that social media provider’s privacy policy for information about how it uses such information.

Billing Information. We utilize a third party, Authorize.net, to bill you for your purchase of the SatPaq and use of the Service. In the course of billing you for your purchase and use of the Service, Authorize.net may collect certain information from you, including your credit card number. You can view` Authorize.net’s privacy policy at https://www.authorize.net/about-us/privacy/. We also may maintain records regarding your purchase for internal business purposes.

Browsing Information. We, or a third party such as an analytics provider, may collect information about how you use our website. Such information could include, for example, information about the computer, device, or browser you use to access our website, and the sites you visit before, during, and after you use our mobile app or visit our site. We collect this information using cookies, web beacons, and similar technologies. We use this information to better understand how you use our website and mobile app and to improve them.

Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the website or online service that a user visits to indicate that the user does not wish to be tracked. Because there is not yet a common understanding of how to interpret Do Not Track signals, we do not currently respond to those signals. How We Share the Information We Collect

Except as stated below, we will not otherwise sell, share, or disclose information we collect from or about you.

Vendors and Partners. We may share information with partners and affiliates, with third parties who perform services on our behalf, and as necessary to provide you the Service. For example, when you search educational first aid information through Dr. Dex, we may share certain information with the developer of Dr. Dex, DiagnosisAI, such as the question you ask Dr. Dex, though we will not provide specific information about you with any such request. In addition, when you request emergency and SOS service, we will share your location and other information about you with GEOS Worldwide in order to provide an emergency response to you. Disclosure for Legal Purposes. We may disclose the information we collect if required to do so by law or if we, in good faith, believe that disclosure is necessary to (i) comply with a legal obligation or respond to a government request; (ii) protect and defend our rights or property; (iii) investigate fraud; (iv) act in emergency situations to protect your personal safety or the safety of the public, or to otherwise protect prevent risk of death or serious personal injury to you or others; or (v) protect against legal liability.

Anonymized and/or Aggregate Data. We may share anonymized and/or aggregated data with third parties. This may include, for example, general information about your purchase and use of the Service. When we share anonymized and/or aggregate data, it will not contain any specific data about you, or that can be reasonably linked to you.

Business Transfers. We may sell, transfer, or otherwise share some or all of our assets, including the information we collect, in connection with a merger, acquisition, reorganization, sale of assets, or in the event of bankruptcy. If we transfer data under these circumstances, this Privacy Policy will continue to apply to your information.

How We Protect Your Information

Safeguarding the information we collect is an important priority for Higher Ground. We use physical, technical, and administrative safeguards to protect the information we collect and maintain. Please be aware, however, that no information security program can provide absolute assurance. As a result, we cannot guarantee that we will prevent every unauthorized attempt to access, use, or disclose your information.

Links to Third-Party Websites and Content

Our mobile app and website may contain links to websites, apps, or other services that we do not manage or control. We are not responsible for the content on those websites and apps, or their privacy policies and practices. We encourage you to review the privacy policies and practices of such websites and apps.

Children’s Information

We do not knowingly collect information from children under the age of 13.

Your California Privacy Rights

If you reside in California, you have the right to ask us one time each year whether we have shared personal information with third-parties for their direct marketing purposes. Indicate in your email or letter that you are a California resident making a “Shine the Light” inquiry.

Changes to This Privacy Policy

We may make changes to this Privacy Policy from time to time, and we encourage you to periodically review this policy for any such changes, which will become effective when posted. We will notify you of any material changes regarding how we use information we already have collected about you.
